legality of the second marriage

If an individual marries while their divorce is in progress, is the second marriage legal once the divorce is final?

In VA, this marriage is not legally valid and may even be criminal depending on the "intent". However, to be sure the record was completely clear and for practical purposes, I would want to see it "annulled". Also, note that Virginia does not recognized "common law" marriages, as such.
