Liable

Could I be held liable for sending a letter to a persons Executive staff and Board of Directors about an adulterous affair they had with my husband?

Perhaps. Virginia recognizes interference with business relationship as a tort, a civil offense, not a crime.

But the real question whether you should take such action. Aside from shortening the time required to get a divorce, the existence of proof of adultery is useful to you primarily as a bargaining chip, and then only for so long as you still have the threat of making it "public". Once you have carried through on that threat, it no longer has any bargaining power.

Also ask yourself if you want to make public your private life.

No, not if your claim is in fact true,

but it's probably not a good idea anyway, even if legally permissible.
