living together

i have a child he is 10 is not my boyfriend son, his father does not have contac my kid and i want to go to court for a sole custody i heard the living together in virginia is against hte law because i am living with my boyfriend the judge can dineid this petion or can take my kid away from me

If you already have physical custody of the boy and the father apparently has no contact with his son, there would not appear to be any identifiable and compelling reason for bringing the matter of custody before the court at this particular time as the law already recognizes you as the natural custodian of the child by virtue of you being his mother. (No court order rerquired for this particular legal recognition.)
