Legal Question in Family Law in Virginia

I am living with my fiance and he has a 14 yr old daughter that he has 50/50 joint custody of and she primarily stays with us. her mother now is trying to get me kicked out of my resident with him. Is she allowed tod o this even if daughter wants me there.

No, not unless a judge orders it because credible evidence has

been presented in court that your continuing presence in your fiance's residence somehow represents a compelling detriment and/or

threat to the best interests of this 14 year old.
