Legal Question in Family Law in Virginia

living as man and wife for 7yrs. now he wants me and my children out.

I have been in a abusive relationship for 7 years. I have cooked cleaned and washed his clothes and taken care of him ; basically his personal servant. He has been abusing me mentally and physically and now I have decided to fight back. I have enrolled in school full-time and began to work again. He is unhappy with my decisions and is getting more volient. Now i am calling the police only for them to tell me i have to leave. We live in an apartment my kids are listed on the lease but i am not due to my credit. He now throws that up in my face and tells me to leave if i call the police again. I had a home and lost it because of him. Please give me some input on this situation.

Unfortunately, having lived as man and wife for seven years in the Commonwealth, confers neither upon you nor your partner any special rights or remedies for the situation which you've described that you may otherwise have had if the two of you were married.

Therefore, the police, unfortunately, would appear to have given you pretty sound advice for your situation, although, as public servants, they are still required to protect you from any further domestic violence which, hopefully, will not be in the offing anytime soon.
