Legal Question in Family Law in Virginia
Lying on marriage application
If one party of a marriage in Virginia lies on the marriage application stating they were never married and they were, what is the law for this? There is a possibility that the party that lied on the application was not divorced at time of marriage in Virginia

Re: Lying on marriage application
The party who was lied to may have a legal basis to sue his or her lying spouse for an annulment.
(See Va. Code Sec. 20.38.1)

Re: Lying on marriage application
Bigamy (being married to two people at the same time) voids the second marriage since it is illegal. An annulment is the appropriate action. Wife #1 is still wife #1 until there is a divorce.
Good Luck
