Legal Question in Family Law in Virginia

Marital Property

My husband and I are now divorced. There was real estate pudchased during our marriage. He filed for bankrupcy after the divorce and included the house I was living in. However he still owns two properties the house he lives in amd another rental. I would like to know if even though we are divorce and the porperty was brought while we were still married can I sue him for half of the property or request he sell the properties and give me half of the proceeds? I did not get anything in the divorce at all mainly because I did not attend the proceedings and the divorce went through before I knew it.

Re: Marital Property

Whether now at this late date you could demand a share of the marital property which you and your former husband jointly accumulated during the course of your marriage would depend upon whether the issue of the disposition of this property was ever determined and adjudicated in your final decree of divorce.

If not, then, you might still be able to pursue the matter; however, if it was so adjudicated, then the answer is no, you would not be able to.
