Re: Marriage after Divorce
I concurr with the response filed by Ms. Jones, Esq. Clearly the 21 days applies, among other things to review and correction by the trial court. However, I would have to research before being sure the 21 days forecloses all appeals to a higher court.
Re: Marriage after Divorce
Once the final decree has been signed you are divorced, provided it is a decree of absolute divorce and not a divorce from bed and board. However, there is a twenty-0ne (21) day appeal period after the entry of the final decree during which either party may appeal the decree. Therefore, it is best to wait the twenty-one days before applying for the next marriage license and remarrying. If the decree is a divorce from bed and board, neither party may remarry until a final decree of absolute divorce has been entered and the twenty-one day appeal period has lapsed.
