Is my marriage legal? Do I need to get a divorce?

I married an illegal alien 2 years ago. I found out that he did not even use proper identification when we got married. We have been seperated for the past year and a half. I don't want to be married to him. Was this an unlawful marriage? Was it valid? Do I even need to go through a divorce? Do I need a decree of divorce or is the marriage void?

Your marriage might possibly be considered voidable under the circumstances which you've described, however, you would be well advised to assume that the standard procedures for divorce apply in order to dissolve it legally with the degree of certainty which such matters deserve.
