Legal Question in Family Law in Virginia
marriage
I thought that I was divorced. I found out that my first husband did not actually legally divorce me until late 1999 or 2000, (he handled the divorce) AFTER I had already married my second husband. What should I do? Do I have to marry my 2nd husband again. What are the legal ramifications? Are we legally married? Am I in any trouble? How do I correct this? We got married in Las Vegas, Nevada. I married my 2nd husband in Virginia. I think the divorce happened in Pennsylvania.

Re: marriage
The relevant Virginia marriage statutes which would appear to pertain to your particular situation would appear to be Sec. 20-38.1(a)which specifies that marriage is prohibited by law where one of the prospective spouses has failed to properly dissolve his or her previous marriage and Sec. 20-43 which pronounces such marriages as bigamous and void without further decree or action under law.
However, in order to ascertain exactly how these particular statutes may actually be applicable to your particular situation, you should seek the counsel of a Virginia lawyer appropriately qualified to advise you on this matter.
