Legal Question in Family Law in Virginia

I am married, and have a child with another man, my husband supports the child, and is on the birthcertificate, but feels that my babies father should take some kind of responscibility for our son by paying child support. Sorry just had to give u a little background behind my question, but my question is. How do i petetion the court for paternity in the state of virginia do i have to pay for it, once paternity is established can i leave my husband on the birthcertificate, or would i have to put my babies father on there? Thank You.

Go to the clerk's office(civil division) of your local J&DR;Court and

tell tell the clerk you want to file a petition to establish paternity

of your child allegedly fathered by a man other than your current husband.

The court will decide who pays for the paternity test (which likely will depend upon the results) and whether the birth record is to be changed in its order.

The juvenile and domestic relations court can help you file a petition. I believe it is $25.00.

You should have an attorney represent you in court. But having the court do the petition may be cheaper than having the attorney type one. You usually have to have an appointment to have the petition drawn up. Web: www.sherylshanelaw.com. Tel. 703 503 4448.
