Legal Question in Family Law in Virginia

I'm married to a dual citizen of the U.S. and Japan. We have a daughter who was born here in Glen Allen Virginia on September 16th, 2009. My wife has decided to go back to Japan with our daughter and expects me to retire from the military and joined them there.

I don't have any intentions of doing so and was wondering which government would be a able to facilitate divorce and child custody, if it comes to this?

Your wife could file either in Japan(once she has met the eligibility requirements

for divorce in that country), or you could file in Virginia (assuming that you're a

a bonified resident of the Commonwealth).

Obviously, from your perspective, you would very likely prefer the

divorce to be handled by a Virginia court rather than one of Japanese

origin.
