Legal Question in Family Law in Virginia
Hi, I was married in India and filed for divorce in VA, USA. My ex-husband lives in India and never visited USA and he did not respond to the divorce petition that was sent to him by my attorney. I have a child from this marriage who is now 15 yrs old and the divorce petition did not include any child custody details. The child has been living with me in USA for the past 6 years and the father calls her weekly however has not provided any child support ever. Now I am filing for my permanent residency ( green card) and it looks like I will need a child custody document to prove that the child was not abducted. That said, the father is willing to provide a notarized document stating that he is in agreement to the mother ( i,e Me) having the complete guadianship/custody of our daughter. Will this suffice ? Or does it have to be a court document from either USA or India. Since my ex-spouse cannot come to USA( no visa) , I will have to go to India which is not feasible for me at this point. My interview with the immigration officer is on Nov 13 2012 abd I am running out of time on this. any advice will be helpful.

Take what you have(the notarized document) to the scheduled interview and hope that it suffices.
