Legal Question in Family Law in Virginia
I got Married on Oct 4,2006 to a man who lied from the beginning. He is a drug addict. He lied on his social security number and records show he uses two different numbers. Our marriage wasn't even 6 months when he got arrested and put in jail for a felony. He is now incarcerated in a virginia prison and his release date is 2012. I would like to know if that is grounds for an annulment or do I have to go through the court and file for divorce? We have no assets together. We have No children together.

It may be difficult to get an annulment, but it appears to me that you have good grounds for a divorce under Virginia law. Either way you would need to go to court. The fact that he has been convicted of a felony and will be incarcerated for more than a year is sufficient. You can legally do this without an attorney, but you will probably need some professional assistance to get your divorce. Perhaps you should check your yellow pages for a "divorce clinic," as you may be able to get a reduced rate under these facts.
