Legal Question in Family Law in Virginia

Married or not

If a person marries a person from another country then afterward learns that the person they married was never legally divorced from their first spouse in their home counrty, does that make the existing marriage null and void? The marriage took place in the other country and then they returned to the US as man ad wife. There is no marriage liscense or paperwork showing they were married.

Re: Married or not

There is so much missing information in the question that you've posed, that there is simply no way to answer it with what you've provided. If there is no marriage license or paperwork indicating that the couple was married in the foreign country, then, perhaps, in fact, there was no actual marriage at all between these two(or none that would be recognized in the U.S.), and, therefore, we don't even have to consider the other issues which you've raised.
