Mediation in differing states

My husband and I have been married 27 years and

have two grown children. We wish to divorce using

mediation to divide our substantial estate. We have been living in different states for about one year. We spent most of our married life in New York. I have been a house wife for many years and have been unable to find a job to support myself. It seems that both states require"grounds." Can this be avoided in mediation and which state would be better for filing? I am concerned about support also.

You can only compare NY and VA by consulting an attorney licensed in both, or separate attorneys -- one in each jurisdiction. You only need one mediator. Without grounds you cannot divorce. Grounds may be as simple as being apart a year, depending on what the law requires where the case is filed. I will provide the VA opinion without fee if you complete and return my questionnaire.
