Is it mine or ours?

My husband and I have been seperated for 4 month. I have moved out of our home. Everything we own is in my name. Is it mine or ours?

More likely something approaching "ours"; your husband may have at least some marital claim to at least some of the property which you may regard as soley your own.

Everything purchased or acquired during the marriage is presumed to be marital property. You are entitled to up to one half the value of any such property no matter who holds title to the property.

Virginia is an Equitable Distribution state which means that it is not necessarily divided 50/50 but whatever would be fair depending on the facts of the case.
