Legal Question in Family Law in Virginia

Minor Name Change One Parent Deceased

I have not yet found any clear information on how to proceed with the name change of a minor when one of the parents is deceased. I assume it would be the same as if both parents were in agreement and signing the forms only the surviving parent and legal gaurdian would be doing it alone. But there is nothing in any of the laws or assistance booklets that mentions this situation.

Is there anything special that needs to be done if one parent is deceased? The booklets do not say.

The short answer is go to the Fairfax County Circuit Court Clerk's office on the 3rd floor of the Courthouse at 4110 Chain Bridge Road, Fairfax and ask for their help. This is something you can do yourself, with the help of the clerk.
