Minor Child Name Change - VA

I live in North Carolina. My ex lives in VA and has remarried and wants to change my child's last name. The custody order is in VA. She is threatening to take me to court in VA. My ex did not change her last name when she married, (i.e. she kept her maiden name). I do not want my child's last name changed. Or if it is changed, I would like her to take my last name rather than keep mom's maiden name. What should I do

Well, let her go to court for the name change. She will be required to notify you of the court hearing date and give you the opportunity to come to court to explain to the judge why her request for the name change should not be granted.
