Minor's Name Change

Our son's birth certificate - and his SS card - lists his name as John Smith Jones. Smith is his mother's surname and we planned it to be his middle name. Jones' is his father's surname and we planned it, obviously, as his last. However, we now want his surname to reflect both our last names. Thus: Smith Jones. No hyphen. Do we need to have it legally changed (he was born in NC, we live in VA now), noting specifically that his first name is John and his last name is Smith Jones? We intend that he no longer has a middle name but rather uses just a first and last name.

Yes, you should present your motion for a name change for your son to the local circuit court in the city or county of Virginia where he currently resides.

If you contact the clerk's office of the circuit court(civil divison), they may have a packet of forms with instructions available to the public as to how to do the name change without the assistance of an attorney.

It's entitled "Name Change For a Minor" (or something very similar).
