Legal Question in Family Law in Virginia
Missing support payments
Since the CS order has gone into affect last June there has been two missing payments. Written notices had been sent to the NCP who insists that payment was sent. Requested that the check be stopped and reissued, NCP is paying by cashier check so that is not an option. Have received copies of the missing payments, with my signature on the back but my bank can not verify that these ever where submitted. Are these copies enough for a judge to consider them paid ? I have a hearing in March, but do not want to waste the courts time if I have no chance with these copies. they are faxed word documents.

Re: Missing support payments
Your signature is on the endorsement but your bank has no record of the deposit? Are there bank marks on the back? Are you sure the signature is yours? Are you sure you deposited them in the bank?
If the signature is yours, that's sufficient evidence of payment.
The answers to those questions have to dictate whether you bring NCP to court on a contempt of court charge for non payment.
Good luck.
