Legal Question in Family Law in Virginia

I need help in getting out of a mortgage with my ex wife of six years. Her credit is very poor and it is hurting my credit. she does have a steady job and makes the payments, but they are quite often late.

My separation agreement and divorce papers acknowledge that the house is hers. What can i do?

She claims that she cant re-finance do to her poor credit. What are my options?

Demand proof that she has made diligent (and recent ) efforts to refinance the mortgage (which should be required under the terms of the agreement that was incorporated into your final decree), and if she can't or won't provide such proof, then have the divorce case reopened and take her back before the judge on a Rule to Show Cause to explain it all to the court.
