Legal Question in Family Law in Virginia

mother accused of visitation violation

I currently have a visitation order with my sons father. In the order I am to take my son to his father every other weekend. I recently gave my sons father a letter stating that we were going on vacation 22 days in advance. We went on vacation and now I was served by the local police for a crimal summons due to the fact I never dropped my son off at his fathers home. What do I do? Do I have a chance to win this?

Re: mother accused of visitation violation

Sure, you have a chance to win this action for Show Cause which your son's father has brought (perhaps, vindictively) against you.

You'll need to demonstrate to the court that the father received ample notice of your vacation time away from the area and, if required by the terms of the visitation order that he had in effect consented to it----one way or another, even if that means by failing to object in a timely manner.
