Mother

If I am a divorced mother who does not have full custody of my child ,but the father does. Can he pick up and move out of state with our child. Moving from Va. to Alabama. I am a single mom that cannot afford to fly back and forth to visit.

The father is required to give you and the court at least 30 days notice of his intent to move; that gives you time to ask the court to change custody of the child or change the visitation arrangements to make it possible for you to maintain a relationship with the child.

You would be able to move for modification of custody/visitation based upon the move, provided that you could establish that it was in the best interest of the child. I would advise that you consult an attorney for more assistance in this area which is frequently litigated and dependant upon your particular facts/circumstances.
