Legal Question in Family Law in Virginia

The mother of my grandchildren, parents were never married, dropped off the children with me three months ago. Since then she has seen the children two times. She is collecting child support from the father but not helping with support of the children. We live in Virginia where the courts gave her physical custody with visitation to the father. Is there anything that we can do to have her help support the children.

Send the mother written notice that she must begin immediately to redirect

these child support payments to you or you will have to file a petition

with the court to have the current order modified to reflect yourself

as the payee on the case and with a directive to the father or DCSE (as appropriate) that all future such payments are to go to you and not to the mother.

But, of course, if she ignores your admonition, then you must follow through

with filing this petition and having a hearing scheduled in the matter.
