Mother pursuing Child Name Change without biological father since he has never s

I recently married and want to change my sons name to that of my husband and mines.My husband has been around since my son was one (he is now 4 1/2) and my son considers him his father and he considers my son his child. The biological father was abusive and when I left him his only contact was harrassing me. He has never made any contact with my son or suggested in any way that he wants contact. I want to change my sons name. Can I do this without involving the biological father who has been absent in my sons life?

You can pick up a forms packet at the civil division of your local circuit court entitled "NAME CHANGE FOR A MINOR",which will

instruct you how to make the name change for

your minor son in compliance with Va Code Sec. 8.01-217.
