Legal Question in Family Law in Virginia

Mother wanting to relocate children to a different school district

My ex wife has decided that she wants to move and relocate the children to a new school district (within the same city). We have joint legal custody and I currently provide her with more than enough in child/spouse support required to stay within current school. What are my legal rights to prevent them from having to move. Is this a good time for me to attempt to get physical custody due to the change in circumstance?

Re: Mother wanting to relocate children to a different school district

No, I would not consider the proposed (apparently minor) change in the custodial parent's residence as a material change that would warrant the court's reconsideration of the current order involving physical custody.

You, nevertheless, could request a hearing on the matter to oppose this move, but would seem ill situated to explain to the court why the mother should not be able to change her residence within the city where you both reside in the manner which you've described.
