Legal Question in Family Law in Virginia

motion on grounds of abandonment

I would like to know what exactly is considered abandonment in the state of Virginia. My ex is going for full/sole custody on the grounds of abandonment stating that I have not had contact with my children. I pay child support and call just about every day. I have the phone records to prove it. I have not seen them because she will not allow it. I have also put in a motion/response to her motion. I have everything documented showing that I try to contact my children but she will not allow it.

Re: motion on grounds of abandonment

The court will not find abandonment on your part based upon these alleged circumstances and if the mother's custody action is based only on this type of evidence, it should fail.
