Legal Question in Family Law in Virginia

Moving children to another state....

My wife and I are curretnly undergoing a trial seperation. She is originally from West VA and curretnly we are living in Harrisonburg, VA. She has commented a couple of times that if she will not be able to afford to live here on her own if we split finances and will maybe move back to WV (3 hours away) to live with her Mom.

Is there a way I can prevent her from taking my kids that far away from me and keep her from moving?

Re: Moving children to another state....

You cannot prevent her from moving, but there is an issue with her removing the children from VA. The matter would be determined by the children's best interests. Often, it can be difficult to show that the children's best interests are served by pulling them from their community and school.
