newborn custody

How does custody work with a newborn in va when it comes to a father wanting joint custody? the mother is already using the baby stating he won't be able to see it. she already has 3 other kids age 6 and 4? was a stay at home mom but recently got a job. once he leaves she will have to move in with her parents.

The putative father will need to file a petition with the local Juvenile & Domestic Relations District Court requesting that a paternity test be ordered by the court to establish his parentage of the subject child, and, in the event that such is established, that he then be awarded joint custody of the child.
