Legal Question in Family Law in Virginia

Non-Custodial Parent Causing Emotional/Mental Stress

I am the custodial parent of my son for good reasons since the courts ruled his mother was unfit to care for him. I wrote her a letter stating she could take him to Ohio for the T-giving holiday; howver due to recent events I was wondering if I can rescind that letter. All she does, along with her mother & brother, is argue and fight w/ him during visitation, says he is the most disrespectful person, talks negative about me and my wife to him, and tells him all she has to do is sign a piece of paper never to see him again. She even blasts the TV while he does his homework & when he turns it down since she won't - she hits him or one time she grabbed his ankle and squeezed it so hard it left a mark. I already have him in counseling to deal with this undue stress. Furthermore, his school sent hom a letter which enclosed 2 documents & his reoprt card FOLDED and STAPLED addressed to ''Mr. & Mrs. George''. She told him she don't care if it is to us she has the right to open whatever she wants. Can she do that? The court order states we are to provide her with copies of this sort of things, in which we ensure we comply fully with the court order, so we wouold have sent a letter w/ his report card as we always do.

Re: Non-Custodial Parent Causing Emotional/Mental Stress

Unless this non-custodial parent has court-ordered visitation rights which include the Thanksgiving holiday, you should be able to rescind whatever you want to rescind without legal consequence.

As to this person opening mail from the school addressed to you for which she is, however, intended as a recipient, although I can understand your irritation, I don't see any substantive issue here.
