Legal Question in Family Law in Virginia

is it normal for police to question a 13 year old juvenile in an "inappriate touching" of his younger brother and possibly charge him as an adult . He has never been in any trouble . He is staying in a foster parent situation There is a good chance that the male adult is the source of the abuse. The 13 yr old is to be questioned by detectives this SundAY.
