Legal Question in Family Law in Virginia

Overturn custody

I am wondering what the grounds for overturning custody in Virginia are. I know things such as abuse and neglect but I have heard if the custodial parent is not promoting a healthy relationship with the other parent such as denying visitation. My ex has denied visitation for quite some time and has been brainwashing them to believe someone else is there father. In my opinion from what I have witnesses this is mental abuse (PA/PAS) She has put in a motion for sole custody and I have put in a counter motion asking for joint legal to continue but for them to live with me. Do you think a judge will change residence?

Re: Overturn custody

The facts that you raise certainly give you an argument for changing custody, however a result cannot be predicted for certain. Ultimately it will depend upon what is in the best interest of the child. In presenting your side, try to not just focus on the negative aspects of the other parent, but rather stress how you would benefit the child as his/her custodial parent.
