Legal Question in Family Law in Virginia
I am a Pakistani girl, I got married with a US citizen in my country. I was working in Dubai before marriage, he asked me to apply for visit visa and i got a year multiple entry visa. then we got married in pakistan on May 7th, then we flown to US on June 8th.
Then i repetedly asked him to apply for my status and declare our marriage there so that my paper work starts but he kept avoiding. Then he started misbehaving with me so much that i came back to pakistan on october 23rd.
Now he doesn't contact me at all even when i try he avoids.
Now i want to seperate so I would like to inquire that do I have any legal status of my marriage within US? How come i can claim my divorce according to US law?

Yes, your marriage in Pakistan is recognized in U.S. law if it was performed in full compliance with the laws of that country.
In order to be eligible to initiate a divorce in the United States, you would need to have established legal residence in one of those states or territories for the required period of time.
Check with immigration attorney and find out what the consequences are prior to seeking divorce. My office handles both.
