Legal Question in Family Law in Virginia

parent in jail

i have joint legal custody of my child shared with the father. the father lives with his mother. It has come to my attention that the father is in jail. I called the grandmother to let her know that i will not be returning the child since the father is in jail and can not meet his obligation. She told me that she has power of attorney and that he signed his parrental rights over to her. How can that be done with me not being informed by anyone. Do I legally have to return her to the grandmother. The custody aggrement has nothing to do with her in it.
