Legal Question in Family Law in Virginia

Parental Adoption Timing

We were choosen by expectant birthparents (they're not married)to adopt their baby. Both parents are over 18 and the adoption is uncontested. The baby is due in a few weeks. There is no agency involved. There is not enough time to have a homestudy done before the birth. They want the baby to come home with us from the hospital. What will happen when we go to the juvenile court, 10-15 days after the birth, when the birthparents are to sign their parental rights over? We are having a Power of Attorney paperwork typed up now. I am afraid of what will happen if we don't have a homestudy completed before the junvenile court appearance. Will the judge then order a homestudy, before anything else can be done? I want to make sure the baby will be able to stay with us during the process. What will the process be after the birth? Thank you.

Re: Parental Adoption Timing

Yes, of course, the court will order a home study by the local Department of Social Services before proceeding one iota further in the case.
