Legal Question in Family Law in Virginia

Parental rights

My fiance' is ordered to pay an enormous amount of child support for two children, by two different mothers. His last ex wife disappeared with his youngest child at age 4, my fiance' paid his child support to her until she disappeared. The child is 8 yrs. old now and does not even call him Dad, he did not even know where she was, he had to get a divorce from the newspaper. The court makes him pay child support to her even though he did not know where the child was. Is this fair? They have played games with this child (the mother) saying he was going to be adopted by his new step-daddy, and now they aren't going through with it. My fiance' cannot even find work because of child support issues. Like I said, this child does not know him and she is making every atempt to see to it that he don't get any visitation either. We have no money for a lawyer, but by him not knowing the child, he would like to relinquish his parental rights. How can he be made to pay child support for those 4 years that he did not know where the child was?

Re: Parental rights

Do I have to pay child support for a child I never see?

Yes. If you want visitation rights, file a case in the Court where the child lives.

If the child is lost or hidden or never speaks to you, or if you do not desire any contact with the child the answer is still Yes.

The child will always need to eat whether it has a relationship with it's father or not.

Courts traditionally will not allow men to have their parental rights terminated just to escape the payment of child support.

Good luck.
