Passport for a minor

My x-wife, and my--name removed--mother, will not send me the necessary fos to obtain passports for my children. We live in Virginia. What for would I submit to the courts to obtain a Court order specifically permitting applying parent's or guardian's travel with the child; or Judicial declaration of incompetence of non-applying parent?

Re: Passport for a minor

If your child is under the age of 14 both parents must sign to obtain a passport. However, one parent will suffice if: that parent produces evidence of sole custody; or, the parent seeking the passport obtains court approval to travel with the child. You would need to make a motion to the court requesting such relief. This would be the appropriate way in the absence of a reasonable basis to seek a change of custody.
