Legal Question in Family Law in Virginia

Paternity through artificial insemination

In a case of a married couple where the wife was artificially inseminated with donor sperm can the husband claim that he is not the father of the child?

If he can, what does he have to do and when?

Thank you,

Spyros

Re: Paternity through artificial insemination

Virginia Code Section 20-49.10---

Relief from legal determination of paternity---should answer this question. In part it reads as follows:

"A court shall not grant relief from determination of paternity if the individual named as father (i)acknowledged paternity knowing he was not the father,(ii) adopted the child, or(iii) knew that the child was conceived through artificial insemination."
