Legal Question in Family Law in Virginia
Paternity rights
Does a man who thinks he is the father of my baby have the right to get a paternity test done on my baby? Would it be illegal for a man who is not the father to sign a birth certificate stating that he was the father?

Re: Paternity rights
Va. Code Sec. 20-49.2 gives a person who believes he may be the father of a particular child the right to petition the court for a paternity test.
If a person acknowledges paternity of a child(including signing the child's birth certificate as the natural father), knowing that he in fact is not the father, he thereby later foregoes the right to petition the court under Va. Code Sec. 20-49.10 for a paternity test to prove that he is not the father of the child which he previously acknowledged.
