Legal Question in Family Law in Virginia
Need help with paternity of 11 year old.
I am writing this qustion for my husband. He had a one night stand about 11 years ago, about 1 year after that the woman contacted him, she mentioned the child but said that my husband was probably not the father. My husband said he was willing to get a paternity test, but he simply didn't want me involved until we knew one way or the other, I had just had our son and he was premature, etc. (we were NOT married when he was with this woman or even dating) He told her he was willing to take a test and help, he never heard from her again. Now, 11 years later she contacted him through myspace of all places, saying he is most likely the father, and she needs closure etc. Needless to say we have many questions. I think our biggest fear is that this is about money, WHY after 11 years is she trying to contact my husband? And if my husband is the father, he would have taken care of this girl and wanted to be in her life, this woman robbed him of that. Any help or advice would be great as this is effecting my health and our five little boys are starting to sense that there is an issue at hand here. Thank you.

Forget about all the whys and speculative trains of thought; tell the "myspacer" to get a court-ordered paternity test and your husband will comply---and go from there with whatever the results of that test may require.

Use the Juvenile Domestic Relations District Court in the county in which you reside to obtain a court order for a paternity test. That process is form-based and relatively straight forward.
