Legal Question in Family Law in Virginia
Is it likely we'll have to pay her lawyer's fees?
My husband just went to court with his ex-wife. After 3 years of trying to resolve problems out of court, he filed show-cause papers due to her not allowing him court-ordered visitation with his kids. In court, her lawyer asked that the show-cause be stricken from the record, & the judge denied it & placed her on a 6-month probation. The ex-mother-in-law told me that since she was the one who had to put out money for her daughter's lawyer, she is going to sue my husband for lawyer fees. My husband represented himself & therefore hasn't incurred any lawyer fees of his own. The case was treated as a criminal show-cause rather than civil, & the ex-mother-in-law said they were forced to pay for council & that the court wouldn't hear the case unless she hired representation. Being that it was found to be a legitimate complaint, is it likely that my husband would have to reimburse his ex-mother-in-law for her lawyer fees? Also, they have a follow-up court date set for November 10th. This past weekend was the first weekend since court that we were supposed to have the kids. His son came, but his daughter was ''sick'' & had friends spend the night. Do we just continue to document, or is it something we need to bring up right away?
