Legal Question in Family Law in Virginia

penalization for non-affirmative paternity????

I had a child w/ a person who i was not married to about 5 years ago. After much discussion this person decided that it was in his best interest to pay the child support and decided to pay w/out involving the courts or any type of legal institution. This person has not been very regular in his payments and has moved several times w/out informing me.I have then had to track him down again. When we initially discussed the child support issue i had asked the father if he wanted to have a paternity test done and the father said that he trusted me and didn't need to have one done.I am know thinking about going through legal channels to receive the child support and i want to know if he is not found to be the father is there any way that i can be held accountalbe for the money that he has been paid so far? Is there a possibility that he could sue me and win?

No, the alleged father could not possibly seek to recover from you sums for child support which he paid in resonable belief that he was was the child's father.
