Legal Question in Family Law in Virginia

Other Petitions Filed for Custody

When I went to court to get custody of my grandchildren, the judge dismissed the petition for custody that was filed by my daughter and her spouse. What does this mean exactly? Does she no longer have a chance to get custody of her children? I did not get the children at this time, but I am appealing it. Of the three children, the one we went to court on does not belong to my daughters husband, so does this mean that he no longer can see this child since the judge dismissed the petition?

Re: Other Petitions Filed for Custody

A dismissal of a petition for custody does not mean that the matter cannot be rebrought at some futute time. And, no, the fact that your daughter's petition was dismissed should in no way impact her right to have visitation with this particular child.
