Legal Question in Family Law in Virginia

Phone Conversations

The noncustodial parent continuously tries to bash and denigrate me to our child. It is in the court order not to do so. Can I record the conversations our child has with the noncustodial parent when they call to speak to the child? Is this admissable in court?

Re: Phone Conversations

Yes, you could apparently record the conversations

as long as the child was agreeable to such recording. (Virginia is a so-called one party state when it comes to such recordings where only one party to the conversation is required to give her permission.)

And, no, such conversations would be unlikely to be admitted into evidence by any court unless the noncustodial parent was aware of and had given his permission for the recordings.
