Legal Question in Family Law in Virginia

I have physical custody of my child but joi nt custody with his father. He disappeared for 5 months. In that time i moved out state but had not way to contact him . i contacted me out of the blue demanding to have his son for a month or he will have me arrested for kidnapping. can he do that.
