Legal Question in Family Law in Virginia

Plastic surgery as a marital asset

My wife and I are pending a divorce. During our marriage, my wife had $10,000 of plastic elective plastic surgery (breast enlargment and face lift). Can the plastic surgery be something that is considered as a marital asset? When she decided to have it, she asked me what I thought, and I told her that she was beautiful as she was and that it was a waste of money, but she decided to have it done anyway.

Re: Plastic surgery as a marital asset

You can always try to receive reimbursement but I can tell you now it is probably not worth your while if she refuses to sign an agreement reimbursing you for that amount because a trial (if this the only point of contention) will be expensive. The best way of recovering this expense is to get her to sign an agreement out of court. However, if there are other issues that are in disagreement and you'll be going to trial anyway you should include this as a claim, not as a marital asset, but a marital debt.
