possesion of property

I have not yet filed for a divorce. My soon to be ex is having an affair. He has not resided at our home for over a month. The house is titled to him solely but it was acquired during our marriage. What are the laws regarding possesion of the house?

You may have a marital claim to the home in terms of its ownership value deriving from your marriage, but as regards temporary possession of the property pending a divorce, a court often will decide this issue when one of the spouses petitions for temporary (pendente lite) support and maintenance.
