Legal Question in Family Law in Virginia

Possession of the house

My husband and I are getting divorced. He wants me to move out as we started separation. Does it matter who lives in the house at separation? How does that impact property distribution? Thanks a lot!

Re: Possession of the house

No, it does not matter which spouse resides in the home at the time of separation as to the ultimate disposition of the marital property.

That is not one of the factors which the court will consider in the event that the marital property must be equitably disposed of.
