Legal Question in Family Law in Virginia

Power of Attorney

In the state of Virginia if a couple has been physically seperated for over four years and they have already filed for divorce and they are just waiting for a hearing date is it still considered adultry if the parties have a close relationship with a member of the opposite sex?

I concur with the "reply" you have already received. However, some research might reveal some qualification of the general rule under some specified circumstances such as yours. I have a very vague recollection of seeing something way back in one of the legal journals. I don't have that final answer just now.

Re: Power of Attorney

Yes, it could be, and would, if so found, constitute a fault ground against the offending party.
